My Workers Comp.

As you all know I was given Per. Total with open medical. Which means they will pay me indefinitely. I have gotten my back pay and have gotten 2 of the bi weekly payments. I am on Social Security also, I have now gotten all the things that SS needs to do the offset, and I am waiting to hear from SS also on how much of my back pay they will require for the offset, I have put the monies in the bank and will not use much of it right now. If I go and spend it to pay off my bills that we are all behind on, I will get caught up in a trap that I will owe SS and will not have the funds to give them. So I wait patiently to get a letter from SS explaining it all.. So we sit and wait again.
Cervical Fusion 2003, c5-c6. Herniated and damaged Disc L1- L4-L5 S1. Lumbar Spinal Cord stimulator implant 09-2008. Cervical ACDF revision with hardware c4-c5-c6-c7 Sept 2009.
SSDI approved 3-2010. NOW OFFICIALY RETIRED

When I got approved for SSDI they told me at the hearing I was given it. The next week they called me and asked me to fax my WC payments to them so they could figure the offset. I was surprised after it took so long to get it that they were working do fast to get my paid. Last year they even figured out they were under paying me for my son and I had the money in the bank before I got the letter telling me they were going to back pay me for him. Just in case they screwed up I took it out of the bank and locked it up so we would not spend it. It's been about a year since they did that so I would assume they didn't screw up. Now if they stop paying me my SSDI would go up

I took Indemnity payoff and my Attorney used the spread languge so SSA got ZERO offset.

My Indemnity was big enough to cover approx 15 years BUT figuring in the offset it would be better than that.

I also have made approx 8% on my Indemnity in the last 2 years. I invested it in Mutual funds thru Wells Fargo. I just pay taxes on the 8%.

I wanted to totally cut ties with WC Forever. I got a really nice Indemnity and $300K+ MSA in my settlement in 2012. I am glad I have cut these blood suckers out of my life. I read a post under the other forum where someone was having issues getting WC to approve there physical needs and they have open medical also for life.

I did not trust WC to go with open medical...........

Had a car wreck in 2003 while on the job. Settled in Jan. 2012 with Indemnity pay and a MSA. Approved for SSDI in March 2006. Was declared PTD at IME in 2009. Took approx 3 years to finalize the WC settlement. ALWAYS use spread language when settling Indemnity or SSA will nail your fanny.
