California bills to help injured workers
California injured workers, there is only one way to change what is occurring in our workers compensation system, and that is by changing the laws. There are 3 bills that will help injured workers in our state. I will list the bills below and ways to contact your representatives if you chose to support them. Often times it can be confusing on who to contact.

I am asking if you support these bills to write or call your local assemblymen and local Senator. You can find out who your district falls under by entering your address in the link below. It will give you your districts contact information. You can find that here.

If you want to go one step further and see if your Assemblymen is a member of the California Insurance Committee, you can look here. This is a list of members who will be meeting on April 23 2014 about these bills.

Many do not know you can call these representatives and offer your support of or against a bill. This only takes a few minutes. You can also ask you friends and family to do the same.

You can also offer support of this bill to the current chair of the insurance commission, which is Assemblymen Henry Perea District 31.
P.O. Box 942849, Room 3120, Sacramento, CA 94249-0031; (916) 319-2031

The California Insurance Committee will hear testimony on April 23rd 2014l at 9:00 am in room 437 of the capital for 3 workers compensation bills that would help injured workers in our state. Members of the public should be able to give testimony. Those near our capital in Sacramento, I encourage to go.

These are links to read the entire bill.

AB2604 increases 5814 penalties to insurance companies who illegally delay benefits to injured workers. Before this bill it was 25% or up to 10 thousand dollars penalty whatever was LESS, this bill changes the penalty to whatever is MORE. This bill is VERY important.

AB2378 would change current law that that caps police officers and fire fighters TTD to 104 weeks and runs other year’s worth of salary continuance under code 4850 along side of the 104 weeks. This bill would not count the salary continuance against the TTD. They deserve it.

AB1746 would allow injured workers to receive a priority conference if their employer is illegally uninsured and their employment or injury is in dispute.

This is a sample letter for AB2604, which is the most important of the three (IMO).

Re: Pledge to Vote in support of AB2604

Dear Representative ________ / Senator _____________

I urge you to support AB2604.

AB2604 would amend labor code 5814, to allow The Workers Compensation Appeals Board to assess penalties of 25% of the unpaid benefit or $10,000. whatever is greater upon finding a carrier unreasonably delayed payment. Currently, the section authoresses penalties of 25% or $10,000., whichever is less.

Many workers compensation insurance carriers are illegally delaying benefits for injured workers. This is due to a lack of penalties that can be levied against these actions. AB2604 will help injured workers by giving more accountability to carriers, if they chose to illegally delay benefits.

(insert a personal story if you wish where your carrier illegally delayed benefits, example ignored or late UR requests from your doctor and how you suffered from that)

Most Sincerely,

I am not an attorney.Anything I write should not be considered legal advice.I am writing from my own personal experiences, which is not from any sort of legal background. You should consult with an attorney over legal issues. In California, if you cannot get an attorney you can consult with an I&A officer.
