Truckster, I fully agree with the above reply you made. And like you, yes, I been down that road before, with both the Labor Board and EEOC. But I have been there helping fellow co-workers before also. I was like you, in the business since 1981, went to school all the time, schooled online, and also at work. I was given many priveleges also by the Manufactor, and I do think that was a thorn in my bosses side, for no one ever was allowed to make their own judgement calls on warranty before. I was allowed to also extend warranty if I had felt it was a ongoing issue with the person and the equipment. Trying to help prevent buy backs. But also, I wasn't employed buy the Manufacture. Yes, they needed so many people with certain Certifacations also for other better benefits. I was certified in many more the most where I worked. I had worked with enginerrs from all fields also. The were many times I had showed them the repairs. And many times they ask to hold the item to come down and watch the repairs. Been there many times.

I do agree you have a claim, and pray you get the right to sue letter and go after them and win big. I'm all for it.

As you read what I posted was just some facts of legall issues and how an employer can work around them. We all need to have the chance to learn. Just things that are written, you will find, there is much more behind the Laws and Rules that is provided to us. So, then we have to learn those issues.

BB,IF AND WHEN THE EEOC MAKES A DECISION AND SOMETHING DOES COME FROM IT,IT MIGHT BE THE ONLY THING GOOD TO COME FROM MY INJURIES BECAUSE I DON'T PLAN ON SETTLING WITH W/C ANY TIME SOON......

You sure are up on your facts and laws, as you know I too am facing the same problems as truck. Maybe me being in the union and our contract gives me a little more time but like you said they do not have to offer me anything. What the lady from HR said was, "I must try to find something else within the company that I can do or I will be seperated from the company". The only problem with that is my union UTU only covers 2 depts. and I must take a test and if I pass the test I will be forced to bump out some other poor injuierd worker with less senority then myself.

The only thing that is saving me is the fact that the contract gives us 12 months to be out sick and they can't do anything until I either return or the 12 months run out. My attorney is in the process of depoing the doctor that for some reason felt I could no longer do the job ( was doing this job when I went to see this quack).

I don't have the age to retire either i still need about 13 years, but I will have my 23 years company time next Oct. So I am praying everyday that things work out next month and this doctor amends his report that he copied from old reports when I was first injuried.
