Can my boss do whatever he wants?
Hey all. My injury was the result of a slip and fall incident at a restaurant. The whole ordeal with my injury has been going on for the past year and a half. I worked at the restaurant while attending college full time, which I am still doing. Apparently the owner is "tired" of paying my comp. wages and wants me to work enough hours to cover what I am receiving in comp. wages. However, due to my college schedule, I do not have the availability to work the hours he wants me to work.
Can my boss MAKE me work all of the hours he wants, regardless of the fact I'm putting in over 40 hours at school with my internship? I know if he offers me a position that I can work I have to take it, but is there a limit on the amount of hours he wants to require me to work? If I cannot (due to college conflict) work the hours he requires, can he fire me and/or cause me to lose my benefits? This guy has been a huge jerk about the whole incident and this is just another bump in this long road. He acts as if this is all my fault. I'm sure many of you have been made to feel the same way. I hope this all makes sense. I need all the help I can get and I appreciate all of your helpful advice. |

I don't know all of the rules, but I think if you are physically able to work you have to or the employer can fire you and you can lose benefits. Those are just my thoughts, someone that knows more will come along and give you better info.
I wish you the best of luck and I hope school is going well! Sorry, I meant to say that if the work is within your restrictions from your Dr, you have to try it. Does that make more sense? |

The answer is possibly. To be more specific you will need provide information as to the State you are in. The nature of your injury and any restrictions the doctor has placed on you. More than likely the restrictions will be the determining factor.

Maybe i missed your injury and where you live. But depends on your doctor of what your duties will be now and the times your doctor wants you to work. Your doctor should of put you on so many hours a day and to lift so much weight and drive occassionally etc. If your doctor does not state that on there, then your boss probably can get you back to your full hours you were working etc.
This may be different as you go to school also. I know if you quit your job, you would still be entitled to medical care through wc and your medication and doctors visit, gas for appts. etc. will be still paid for and also therapy.
