Injured in Arizona
Hi-
I hurt my back on the job on 7/22/07. It was a strain or sprain and the doctor took me off of work. I filed a workmans compensation claim and it was denied before they even investigated. I then filed with the industrial commission for a hearing. I cannot afford an attorney. The insurance companies lawyers have sent me interrogatories which I am working on presently. However, I am unable to list my witnesses because the company will not give me their last names and addresses in order for the judge to subpoena them. How can I get this information? Can I send an interrogatory to their attorney's? Any help would be appreciated. Thanks much. |

Industrial Commission employees cannot give legal advice. The Industrial Commission Ombudsman Office can give you general information about the workers compensation system, the hearing process and the rules that apply to hearings. The Ombudsman office can answer general questions and may be able to assist you in understanding some of the paperwork you have received.
Check with a few attys if you haven't already done so; many will represent you for percentage of whatever benefits they can obtain rather then up fornt payment. The defense attys represent the carrier/employer so if you need information from the employer you can request it from their attys. |

I do know other people in the company but they have all been told not to talk to anyone (including me) about this matter. The Ombudsmans office at the Industrial Commission just told me to write a letter to the judge explaining the situation. I will try that next. |

I have already taken that route, although they suggested that I write to the judge and explain the situation. I've checked with a few attorney's but the case is not worth enough $$ (medical & lost wages come to 3,000) to them. I was only treated for two months and my lost wages are from a 10 hr a week part time job. I like your suggestion of getting the information from the defense attorney. I spoke with their paralegal today and explained the situation. She did not offer to get the information for me but said I could inform the judge and submit an Interrogatory to them. They actually asked me for these witnesses names and addresses in their Interragatory to me which I just received. I also called corporate human resources and the woman I have been speaking with is not consistent with the truth. She told me 3 weeks ago she would see about getting this information to me but never called back. When I reached her today she said I would have to subpoena it to get it. Can I get all of these legal forms on my own? I just cannot afford to pay an attorney. |

Just a note. Call again and ask the same questions you did the first time. I am not in your state. however in my state, I also have the service of ombusman. I have learned to call twice with the same questions. I was suprised at how many times I got different answers. So now I call three times.

Contact the Arizona state bar. The legal profession doesn't like to see anyone who needs an atty to go without.
