Soon to end...I HOPE
NJ, injured 2002, acl knee reconstruction in 2003, revision 2004,also lumbar disc herniations. 400 week's ttd ended 5/10. Denied medical treatment from 2005 to 2011. In spite of 70+ requests for treatment by atp thru the years. Had hearing and all medical treatment was authorized by judge. Reached MMI 6/11. Rated by IC doctor 1/12 and by my doctor 7/12, who rated me total disabled. I have not received any any money from the IC since 5/10 will this amount be retroactive when case is over? At my previous rate or will it factor upon the IC rating of 1/12 and 7/12. Can the IC be fined and the fine reverted to me for the lack of medical treatment? Going foward my atty said that I will be receiving payments for hundreds of weeks or maybe for life depends on final settlement. Hope that this ends soon now that the final ratings have been done or can this still linger on. Thank You, NYCPAL

Thank You, NYCPALfines are levied and and paid to the state not to claimants. there are penalty provisions for unreasonable delay in benefits. start date for permanent impairment is determined by your MMI date and it can be retroactive. |
