Hello I have been out of work for one and a half years now and settled my case C&R in june of 2012, it did not settle employment. I got a letter in the mail from HR stating i will be terminated in september of 2012 because i have not been back to work and if it's due to a disability that they can accommodate me and im invited to go through a review. My question is when I send in my request should i use my workers comp return to work note from my doctor or should i go to a new doctor out of workers comp practice and get a note from him or her to request accommodation from HR?

I personally would stick with the restrictions from the WC claim dr.. If you know go out of pocket or use personal medical insurance. I am afraid it is not going to look good for you. Right now, your employer has the same list of your medical restrictions that you do. They are saying that they can accommodate those restrictions.
If you are still interested in working for them. Then go and see what they have to say. With a claim being settled, work is actually a good thing. 8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins. Soilders died for our freedom. |

[/quote since they believe they can accommodate your restrictions I assume they are using the ones currently in place. I can't see the value in trying to get others. |

I too agree with both AQA & 1171..
I wouldn't waste time / money in another dr visit... |

Yeah i wont , I thought since im finished with the workers comp part of this mess that i could see a doctor out of workers comp to return to work but im sure they will remember my restrictions from comp doctor. They never accepted the doctors note from workers comp but now want to invite me for an accommodation review after the case closed , it seems weird that HR wants to give me a job because i got a SJDV and thought that meant they could not accommodate my injury but im still gonna try and see what happends. |
