question..
Hello everyone. I am new on this site. I was injured at work back in june 2011, I damaged my upper spine & brain injury that effects my balance and memory. Severe pain walk with a walker/cane. I am on my 3rd attorney and nmow this one wont give me my imparement rating. Whats up with that? is it some sort of trade secret or something? How the heck do you find an attorney that goes the extra mile?

How the heck do you find an attorney that goes the extra mile? you mean a doctor reported a rating on your comp injury and sent it to the carrier and your atty but the atty won't share the information with you? rules are different in every state. |

im in florida. Im supose to go to my mediation on monday but I have a sneaky suspicion I will be firing my attorney monday after the meeting. I dont get it....all I want is an attorney who is up front with me and answers my emails within a day or 2. Is that to much to ask? I wanted my MMI info so I could do some of my own research, I mean, this is my whole life and I will only get ONE shot at this to get it right. I guess im just frustrated because these atts treat ya like a number, instead of realizing that there is an injured and scard person behind each case.

in many states it is too much to ask.
the fee in comp cases is often very low which makes it a volume legal business. high client loads means less service for individual cases. not only are the fees low but the settlment amounts as well. comp was originally designed to be handled administratively and litigation was rare and discouraged. |

I guess I figured that with a spinal cord damage & brain damage case, it would reflect more value than the standard" sholder injury" . Thanks for the ear, I appreciate it

nah not really and you will run out of lawyers willing to take your case because they will have to share one fee..you will be paid a settlement depending on your disabilty percentage there is no "standard". Jeri Monster just might disagree with you when she is balled up crying in pain in her recliner that your claim is "worth more" than hers because yours is a "spine and brain injury" I also have a spine injury but wouldnt begin to belive my pain was worth more or hurt worse than a frozen shoulder....
Workmans Comp does not pay pain and suffering.So your going to be paid a percentage of your pay reguardless of the injury.Many on here are spine injurys and are 10 years into their claims still trying to get fixed trying to hang onto their homes and marriages.....its a long haul for some ;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

that sucks! Im sure my injuries are small compared to some out there. I am supose to go on monday for a mediation but my attorney has not even discussed it with me yet. Im new at all this lawyer stuff. Im worried that he will want to settle without concern to my financial needs. I can no longer work and my Dr's know it. I just dont want a settlement that I have to use for an income... my injuries are severe enough that they SHOULD ( in my opinion) offer a seperate income as well as the monies portion of the settlement.

Some attormeys lack emotions for thier clients, are either to busy or are just in it for the settlment.. Obviously you had a impairment rating done, request it from the dr so you have a copy.. Its a dog eat dog wc world, some give up and there are some who loose everything including marige. Even if your attorney has accepted a low ball offer, you dont have to accept it.....
