I am an injured worker in Nj. There were three time frames when WC IC deemed me noncompliant, the judfge overruled one time fram, yet the othwer two were nevwer presented. The one period was when a nurse case manager got aan MMI from a doctor, yet it is obvious I was still undergoing medical care on a constant basis. This period was from Sept7,2007- July 11, 2009 as a family with 4 children we akmoist lost everything. My husband had to work 8 plus hours a week to just make our bills. Then at the start off my injury, before I went for my first surgery 11,07,2005-12/29/2005 they stopped for no reason, I had the surgery on 11/22/2005. The period which was the onlyb one the judge knew about was , November 7,2006-February. 17,2007. I had two surgical dates before my surgwry on February 17,2007, my primary doctor & the surgeon both refused surgery due ro my asthma. Is tnere anyway I can get the money paid back for all this time? I know ther is a 25% penalty in Nj to the IC, I asked my attorney he said that never happens? Any suggestions[/size][/color][/font][/align]
