Light Duty That Isn't So Light

My girlfriend tripped & sprained her ankle at work this week. It is a workman's compensation claim & her doctor's orders are to return to work under light duty that is sit or sit & stand only. She works at a nursing facility as a CNA. Their light duty assignment is to go from room to room speaking with patients. Now this facility is 8 floors high and requires a lot of walking to get around which is completely against the doctor's orders. Now her ankle pain is flaring up. She told her supervisor & the response she got is to either go sit down & ice her ankle or go home. Are they violating the doctor's orders & what should she be doing about it?

She needs to advice her dr/s. what is reqiured for her to do her job.

I ran into the same situation. That my job had no light duty work for me that followed his instructions. He then took me off work status. Meaning; I could not return to work.

the doctor's order were for HER to perform lite duty not for the employer to provide it.
if she chooses to do more then sit or stand, it's on her.

many states will provide disability if the employer can't provide modified work but don't know about yours.

both AQA & 1171 are correct...


Inform her to let her boss know that what she can / can not do.. If they cannot comply with that then she can draw her benefits thru the WC IC..

But she does not need to force herself to do something b/c they can / may only make the injury worse.!
