Can I get some thoughts on this...
Today, I get an email from my attorney out of the blue basically asking me to think about settling my comp case. I am in PA and have been on comp since Nov. 2010. I had an IME done in February of this year. To this point, I have not heard anything pertaining to the IME. I have had one surgery already with a second on the table. The second one would be done to try relieve my nerve damage and decreased mobility and range of motion in my left forearm. I basically can't rotate my wrist in either direction. My surgeon tells me there are no guarantees this will work. So, I can either get better, worse or stay they same and of course the rehab would start all over again.

Seems like my attorney is looking to get paid but I would like to get some thoughts on this. Thank you.

The big question that comes to mind for me is why does your lawyer feel that you should currently consider settlement. It could be any number of reasons, so I would strongly suggest that you call your lawyer and find out exactly why he feels this is a good idea at this time. Furthermore, you need to understand that as an attorney, he is ethically obligated to keep you informed of the status of your case. This could be as simple as your attorney received a call or letter from the defendant inquiring as to whether you are currently interested in settlement. This would result in a brief letter inquiring as to whether or not you are currently interested in settlement, which should not be construed as the attorney's opinion that settlement is in your best interest. Bottom-line, your first step should be to call your attorney and find out his position in regard to settlement.
