Impairment Rating
I am from TX and I had a contested case hearing a few weeks ago.
The judge sent a letter of clarification to the state dd DR. with other evidence ( Medical Documentation) disputing MMI and Impairment Rating! The dd responded back and found that he used the wrong guideline for my impairment and increased my impairment rating from 7% total body to 16 percent. That was just 10 days ago! The insurance carrier already sent me a check for the difference! Which is several dollars, does this mean that they are conceding to the amended report? We haven't even had closing arguments yet!

RE: Impairment Rating
sounds like they always agreed with the basic medical findings and supporting studies on your condition and function.
the fact that the math and calculations had to be corrected was probably not really an issue for them.

your underlying impairment isn't really in dispute just some formulas.

RE: Impairment Rating
Texas uses the AMA guides 4th edition. it's 300+ pages on how doctors are to compute and calculate rating percentages based on their examination and findings.
doing a rating is complex.
if you get a chance on your next visit ask to review the manual.
