tired of getting the run a round
i was injured aug of 2008 in wyoming, since that time i have had 2 back surguries the first was a 2 level fusion L4-L5,L5-S1, the second was to remove the hardware, i have some very hard to live with restrictions for working, work comp keeps sending me things to fill out then tells me i am not at that point and denies them, i have been put at mmi, with continued symptomatic care needeed, now in laymans terms from my dr and according to the ama my dr says i am basically 2 points from totally disabled in my back, noone will hire me due to my restrictions( no sitting for < 1hr, not standing <.5hr, no lifting over 50#, and occ lifting <25#) so i am still unemployed, i can not file for unemployment till work comp settles with me, in wy wc pays my atty but that is a fight to find one due to all the confusion wc has caused in my case, i am however curious what the human back is worth when you are classified as bein disabled, wc only pays lost wages for 24 months so i no longer have income but they are trying to settle and i am sure are gonna screw me with the offer so i just need to know what the award should roughly be, any help would be greatly appreciated

RE: tired of getting the run a round
okay I am confused you are at MMI so you are as good as you are going to get.2 pts off totally disabled? I dont get this part.....I got a 77% when all the body parts were added up or 75% whole body....I am now on SSDI so I dont understand your 2 point thing....your award no one here will be able to even guess at without your knowing all your info and then it would be a guess all awards are different
;)Workmans comp is not a road you want to travel alone. You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life, you have come out ahead of the game.....

RE: tired of getting the run a round
ok the 2 point thing is just for my back from my understanding the body is broke down into 4 parts, 25% each, and i have 23% loss of just my back, thats at least how it was explained to me, i do not think they added all the body parts up, which i think is why i am having such a problem finding an atty, as for ssdi i have been fighting with them too they say i can work but all the fields i have worked in will not hire me and i can not get help to train in another field since i am limited to 5-6 hrs of work a day and the aid goes to people who can work full time

RE: tired of getting the run a round
you should appeal the unemployment denial.
if you are at MMI then the restrictions are permanent and partial, and unemployment is available in those situations. workers comp does not pay wages. they pay disability; the calculation is based on your earnings. more here on unemployment and workers compensation: http://www.wyomingworkforce.org/job-seek...s/faq.aspx |
