should i try for ssdi?
hi again, all this talk about ssdi has got me thinking i should apply. i was injured 7-19-2011 and am going for a fusion this month, i was told by surgeon ill be better after 4 month recovery but ill still have a herniation at T12-L1 that causes aot of breathing and pain problems so ill definately be out longer.plus he is fusing to a bulging disc. ive tried to remain optomistic about getting better(ssdi seems so final)but i dont want to lose money either. and if i doget better, they will cancel it right, will i have to pay anything back? do you have to be at the end to apply? or can it be used as a temporary disability? if i do apply i will NOT use an attorney, i know they get a % off the bat but do they also get a % out of each check too(future payments)? thanks again,

SSDI is supposed to be if you are going to be out of work for a year or longer,that no longer applies as it can take 2 years or more to get it.If your Dr thinks you are gonna be "fixed" after your surgery you most likely dont need to apply.Only if you are going to be off work permantly or for several years

and you've already been out a full year.
once you can work, SSDI can easily stop it so it's not as if there will be a problem.
definitely apply.

Jayc123 Good point. 1171 also stated that you have to be out of work for at least 1 year. Right now I am working but on a modify duty. I was told by the doctor that I will only have a 50/50 chance of recovery and he was optimistic about the recovery & suggested for me to take a permanent modify duty. However I was told by my HR that they cannot accommodate a permanent modify duty. So when should I start applying?

my year will be up before i finish recovery from the fusion but i still have another herniated disc to have done afterward that hes hesitant on doing because of failure% but without it i cant bend or lift anything. plus PT in the beginning made that one alot worse so i cant do it for the recovery of this one. thats why im looking into it because it seems like im already in for the long haul and if it takes 2 years to get it i want to start now, thanks

im pretty sure you cant get approved before 1 year but you can start the process, most are denied the first time so the quicker the better. im also on restrictions no bending, lifting, reaching etc for 10 lbs, my work doesnt have anything for me so im going absolutely insane stuck in this house with a 6 and 2 year old. im passed 8 months out of work now so i guess it wont hurt to try, i know at the least ill be out 1 1/2 years and wont have a job then anyway. if your 8 months give it a try, thanks
