I filled out the aplication on line, after being at the ss office to do so.. Thhis would save time on getting a face to face appointment set up.. It was about 2 weeks ago that I did it and today I stopped in thier to see what the hold up was.. I guess there was a screw up with my address, they sent it to my home address and not to my po box even though I listed my mailing address.... "" whatever ""..

I never thought it would be backed up that much, I am set up to go in April 20th... She has noted my file that it was a wc injury that disabled me and I have been pulled out from work since june of 2010..I was asked to bring as much info with me about injuries and wc ins company claim #

Does this mean they will back date it that far....?

And why ask about the ins company....? isnt it jumping the gun..?

I dont know I havnt been through it before.....

It will be back dated to your ssdi filing date not the date you were injured or taken out of work unfortunately. I waited so long to file I totally screwed myself Sad

They wasnt to know about the insurance company because if you are approved and get medicare and have an open wc case they will not pay for anything to do with your work related injuries.

I'm pretty sure I got those right hopefully someone else will come along soon so please don't take my word for law. That's how it worked for me though.

I was paid from the date I applide minus 6 months example...if they found me totally disabled in Jan they started my back pay from june.....we wait on the advice from our lawyers and it screws us because our pay is decided on a % of what we have made in a a certain number of years before...if we have been off a couple of years we a a couple of years of _0_ in there.Also medicade waits 2 years to kick in for insurance for most of you that needs health insurance,and they will cover that injury if you have a medicare setaside soooo you need that

I agree on that Jayne, my attorney stalled me off way to long... It would have been fine if wc was ready to settle but that wasnt the case.. ss told me as long as I have worked 5 out of the last 10 years..

I applied less than a year after I was injured, I was fortunate as Social Security Administration back dated 6 months the date they determined I was disabled.

That made it 5 1/2 months afterthe wc injury as my starting date for disability.

I applied on my own with no help from an attorney, I received the phone call 6 weeks later informing me I qualified for Social Security Disability.

The in-person interview at the local office I belive was a big help in being accepted plus I use to volunteer for SSA under the Zebley Decision doing intake for children with disabilities by assising their parents with the application process.

If you don't have, you may want to try and get a copy of your medical records.

When you have the face to face. Be prepared for any questions they may have. Meaning as much documentaion as you think they may need. I know you applied on-line, BUT, there has been one hick-up already. Lets try and keep another one from happening.

When I had my interview. I took all my medical records + the letter from the IC that stated my claim was accepted ( purpose of that was that it showed the IC name, claim number, employer, date of injury, the addresses , ect, ect.) I took everthing that I could think of that pertained to my claim with WC and the injury. And YES, I knew that they would get their own copies anyway. However; by doing it the way I suggest 1) If you made a mistake when you applied on-line. That will be corrected at the interview and you will have the documentation with you 2) There are not that many people that supply all the forementioned documentaion. It will get you noticed even after you have left the interview. 3) If the medical review of SSA was questions about info. they recieve from you dr/s. They can also look at what you provided for clarrification. After reading this and letting it digest. I am sure you will know what I was thinking when I applied.

8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins. Soilders died for our freedom.

and be sure and let your treating Dr know you are going for SSDI his report goes a long ways towards towards weather or not you get it....

I applied 19 months(April 2005) after my injury in Sept 2003 online. I was called to come to SS office 6 weeks later.
I was denied the 1st time. Reapplied in October 2005; Went before the Judge in Feb. 2006; I was approved and received my back-pay May 2006.

My back-pay was paid back to my injury date in Sept. 2003 minus 7 months. It was 7 months because i was 1 month past 6 months hold back.

My back-pay was approx. $44000. My Attorney received the statutory limit of $5200 leaving me $38800. 24 months of back pay.

To closely figure your possible offset , Take your best 5 years of Income that you paid into SS. Add the 5 years and take 80%. Divide this by 12.



This figure is the max. you can draw. For instance, When I was drawing A WC check and SSDI, It could not be over that value above.

Anyone who waits past 18 months to apply after injury loses money like I did. I never figured I would be totally disabled; I was in denial. I was 47 when I applied.
