Hi there, I'm fairly new to this whole thing.
Backstory: roof was leaking at work, was told to get product from walk in freezer walked in (with the safety coach near by- she told me to be careful) so I walked in sideways on the second step in... Splat. Did the splits on the frozen concrete that had water from the leaky roof. So off I go to the companys dr. Who had me go in the next day on light duty. I got a WC attorney and after 30 days was told by my attny. To see their dr, I was so glad the dr I was seeing said he didnt want to hear anything about nerve pain or shooting pain... Wth. So I go to the new dr and things are fine, than my financial life becomes ruins. I start having a panic attack. Go to the er and am told its stress and am prescribed xanax. I'm so not into drugs so I don't take them. Well the next day my thought process continues in negativity and depression. I wanted to take all my pills and make it go away. I happened to call the suicide hotline... And they sent someone to "talk" to me, yeah...they had me institutionalized. 5150. Once I talk to a psych he asks me if im on any meds I tell him vicodin and tylenol with codeine. He tells me vicodin can cause suicidal ideation. What the heck! The psych says its completely work related and to give the bill to work comp. Yet I still have bills coming to my house. I gave my attny both bills from the panic attack er visit and the 3 day stay at the crazy house. After that I was put on disability and off of work for 6 months. Then my dr put me back on with work restrictions. I was on light duty for 3 months then 2 days ago my boss tells me your going back to your dept. With ur work restrictions. So I went and was so happy. Finally felt useful. I realized that I had forgotten somethings but figured it would come with time. My boss told me she needed an updated list of work restrictions. I do that yesterday. Go into work and give her the note and she tells me we cannot accomodate ur restrictions. I'm flabbergasted and tell her you told me yesterday I could. She said I wasnt supposed to be on light duty that long that they had just reviewed my case and they cannot accomodate me. To go back to my dr and treat with him and come back with an updated list and she said we'll go from there. Thats the thing that gets me she said, 'Go treat with him' well supposedly he wasnt on the MPN which is what the ins. Co. Has said for monthhhs. He and the lawyer says he is on the ins. Co's mpn, not on a little umbrella though of ...I don't know. So now my dr says if they don't accomodate you then your back on disability. Well before I left work I asked my boss how long was my job secure (I'm union) for while I was treating. She said "I dont know because your dr isnt on the MPN" but yet she tells me to go treat with him and get basically better.
So my ? Is I've gotten EDD before under this dr. Will it be the same the second time around.....? Oh and the ins. Co recently sent me psyc dr's in my area to see and to pick one I call and they are all ortho dr's. Are they trying to trick me!? A typo couldnt be that big!
And also should I tell my attny that she said to treat with him?

I'm just so stressed out and dealing with pain

Someone please give me advice..
Oh btw. My dr pnf'd me saying 5 yrs open medical at the least...if that means anything to anyone. He didnt give me a #%.

does "CA?-Ins. CO" mean Claims Adjuster for the work comp carrier or are you in the state of california?

if you are under california comp laws you can change doctors within the MPN any time.
if you want to see a psychiatrist or a psychologist, get a referral from your treating doctor for one that's in the MPN.

I don't know all the state disability insurance laws so I can't comment on whether you qualify,
but if you have reached maximum medical improvement then you are no longer temporarily disabled and won't qualify.

if you want to dispute the fact that you are permanent & stationary (P&S), then you can request a Qualified Medical Examination

Hey we have the same story , I went to see attorney doctor who treated me with out charge and sent me to a psych group after. I was sent back to work for 2 weeks on modified duty from attorney doctor , i gave it to my employer and was on the schedule a week later but transfered to a new store who claims to have no knowledge of my doctors note , so they call me in the office 2 weeks later right after i asked for less hours and was told they cant accept my doctors note and that if i want to come back to work i have to go back to company doctor and if he gives me light duty they will accomodate it. I called my lawyer and she told me that they are trying to force me to go back to company doctor so he can release me full duty and i guess somehow that will mess up my case . IM P&S and continued to recieve SDI with an IME extension that edd sent me to and was denied unemployment because i cant do usual work so im now gonna get an extension for SDI while on psych doctor. They are trying to trick you stay with your doctor that you have now his medical records are key in your case, if the company sent you orthro instead of a psyc then they are denying you treatment and you can go to a doctor of your choice, A doctor told me to do this so i can treat outside of the MPN. Go back to company doctor ask them for a psyc doctor if they deny you treatment then you can go outside the MPN and get better treatment. Yes you should tell your lawyer everything your insurance company tells you so they can document it. I told my lawyer the harrasment i had dealt with since injury from insurance company and employer and she file a 132. I hope you get the treatment you want , your in my thoughts and prayers, MUCH LOVE

I don't know if Im at MMI, my dr said hes going to put down that I need open medical for at the least 5 years. I know I'm not really capable of going back to my job. The requirement is that I have to life 50 lbs. I was on light duty for 3 months. I guess its time I leave the company. Btw, I'm a union employee. My union rep said they need to hold my job for a year. My dr said if they can't accomodate me then in the report it says I need to be on disability, the last psych thing that happened was due to financial stressors.
This forum and others like it make me realize how screwed up the system is there are thousands of us loyal workers out on our a$$es because of work negligience, my company ( a huge grocery chain) was trying to save a buck and not fix their leaking roof and now I'm the one in pain 9 months later. God I could of had a baby in this time! Which brings me to another depressing point. Its not recommended that I get pregnant right now due to the added weight that would be put on my hips. (Did the splits in the walk in freezer) this injury is seriously messing with my LIFE.
1171 have u heard of a dr putting someone on ptd if there job doesnt accomodate their restrictions? ...and yeah CAlifornia.

no I haven't heard of that.
Permanent Total disability is reserved for those that can't work at any job ever.
if you are covered by a collective bargaining agreement then it would supersede other job protections.

workers comp is "no fault" and proof of negligence is not required to receive benefits. both the employer and the employee are to share the costs of the injury.

So then what am I supposed to do? Hobble around looking for a job, and tell them I need to sit every two hours?

Would I qualify for unemployment... My boss said Im still employed though, just not able to work. ? Im so confused. This is my livelyhood here.
