The rain has finally left the N. Central Texas area, at least until next Tuesday. UGH!!! Which means that Nate and I will be able to get the overgrown weed patch under control and on the road to being killed off. Supposed to see upper 70's to upper 80's thru Thursday of next week at this point.

Sad news however has come out of our recent rains here in TX. As many of you know, I suffer from RSD/CRPS of both lower extremeties, toes to hips. Due to this, I belong to an online community thru yahoo for the affliction. We just found out yesterday that we lost one of our TX family members to flood waters in Lexington,TX Tuesday night when her car was swept off of the road and into a creek. Her car was finally pulled from the creek yesterday, enclosing her body as well as that of her dog. Such a tragic loss for her husband, family, friends as well as her online RSD family. Please keep her husband and family in your prayers.

So sorry Angel,this weather is crazy I dont know how you are up,I spent yesterday curled up in bed and have to get up today and bake bread weather I want to or not we are out...so its bake it or go to town and get it....much easier to stay at home and bake it than to get dressed and face the outside world....

At this point Jayne.. sheer will power. It is a bone chilling 49 at the moment, although we are to see high 70's this afternoon. But I have 2 furbabies that depend on me letting them out to do the pooty dooty. That, and my sister is going to a settlement conference for her WC claim in CO this morning and I wanted to go over a few things with her this morning before she went.

She was involved in an MVA while driving her school bus and all the CA did for her was allow her to see a screw ball of a Dr, some physical therapy and 6 sessions of acupunture. Yet both her arms where she braced herself against the steering wheel (she saw the accident coming) as well as her neck and left shoulder (dominate arm) are totally messed up still. Her MRI shows tears in the right shoulder and I could see her inability to straighten her left arm out to reach for things when she was here last week visiting, as well as inability to turn her head either way. And her back muscles feel like they are made out of stone they are so stiff.

The IC is offering her a measly 10,000 on a 13% as a whole body impairment, although they have been awarded the right to recoup all monies spent for her care/treatments from the gal who caused the accident, as well as the man who's car she was driving. Out of that 10g's she has to pay her attorney 20%. Not much left for an injury that took her livelihood and left her with restrictions that she will play hell finding a job under, lost her husband and his income as he couldn't handle being married to someone disabled and lifetime injuries that no other insurance will touch even if she could afford private insurance. She isn't eligible for SSDI as she worked for a school district and they had their own retirement system that employees paid into rather than SS. Then the school district fired her 1 day before her retirement funds would have become vested, giving her a measly $7 g's instead of the almost $30 g's she would have gotten if they had become vested.

I hope that she will at least get some of the things that I advised her to fight for: lifetime medical, attorney fees paid by the IC (if they had done more than throw meds her way, she might have had a different recovery story and MMI period), and lost wages to retirement vs % of body loss.

She does have a 3rd party claim against her own insurance to cover the pain and suffering that the IC can't touch as they have the 3rd party claim settled against the gal that caused the whole accident (and the IC claim was left open so they could go back into court and add more money to their lawsuit/claim against her if needed). Luckily my sis's claim is against the insurance she and her now ex-husband had at the time and since then, she has gotten her own insurance and gone through a divorce last month so her rates aren't going to go up.

Sorry to run on like that... but I am so disgusted by how my sis has been treated by the WC system, more so than even the way I have been. And you wondered how I was even up. Anger can make on do amazing things. Hope that your day and your pain gets better Jayne.

Her settlement talks sounds like mine when they first started. The insurance company offer $10,000.00 at first with closed medical thenit was $25,000.00. Over a years time the offer increased to $50,000.00.

Things changed at the last settlement conference which was a few months after the work comp doctor injured my neck. The attorney for the insurance company came to court and told my attorney, "I just learned Bummer Knees was injured by Dr.E."

Amazing how the attituides changed after learning about the new injury. I was able to keep the cervical injury out of work comp. I ended up setteling for more than my attorney expected I would receive. I did settle with closed medical, which I regret, but only on the knee replacement.

Angel tell you sister to learn to say the word "NO"

Now on the weather, this week as been HEWL on the body, all that rain! Often I do not get to bed until 3:00 am and back up at 6:30.

Angel please share on your sister once you hear how court went.

You aren't kidding about it being hedoublehockeysticks BK. I got about 45 minutes sleep before Randy woke me up this morning getting ready for work. Nothing I could do but lay in bed in agony as I had taken all the meds I could and had about a dozen OTC pain relieving patches on in different places. And once Rebel heard Randy up, nothing would do, but that he be let out of his crate to go outside and go potty.

Sister's case was postponed for 60 days, as the IC claimed that they never received the IME's report. However, they were the one's that sent it to her attorney. I guess the IC was none to happy when the judge postponed the hearing as they has subpeonaened 3 witnesses to testify and had to pay them to be there regardless this morning. Felt they should be able to proceed without that one very important document. The judge shot them down.

Come to find out, the 10 g's they were offering were for her continued medical costs. What a joke. Might have lasted her 6 months if she were lucky with the cost of one of her meds without WC paying for it. She gets the same anti-depressant as I do.. and for a 60 day supply, it costs my IC over $500 for 120 pills. Ridiculous when it costs a measly 7 cents to manufacture each pill. I know that there was a lot of money put into research for this particular medication, but sheesh, it's been on the market for over 5 years now and over 3 million people take it daily (yes I have done my own research). That's a profit margin of $1,474,800,000 every 2 months, or $8,848,800,000 profit on just that one drug alone in a year. That medication alone would take $3000 of the 10 g's in one year. She might be lucky to make it one year with medical treatment/medications (she takes 3 others) with that amount if no further testing needed done.

Sorry for the rambling mind again. Any way, the IC had also withheld $2000 from her TTD payments come to find out so that they could use it to file for the court hearings against the lady that caused the accident. Isn't that illegal ?? I'm sure the judge will award her that, plus interest in the end. But this will give me another 2 months to talk with her and make sure she writes down everything she needs to take to court and have her attorney present at the hearing so that she doesn't get screwed big time. Luckily little sister has been through the system twice and knows what to look for Smile And if I have questions myself, I know how to travel CO's WC laws to find the answers. So I have her back on this one.

Well, our temp is warming up... so I am going to go outside and see what Nate and I can accomplish on the weed patch this afternoon. Enjoy the coming warm weather.

WC isnt a place for quitters thats for sure.....I am glad I am out of it..I live in fear that we will get national health care which will be run along the same lines as WC with the same NCMs and denials of timely care...

It has been cold and windy the last few days, wind gust 43mph left many without power last night. Rain and snow tonight dropping in the mid 20's (( our normal for this time of year )) but mid 60's for the weekend.........

going to be in the 80s here....Quietdude is in the process of tilling my new garden area....we have decided we can no longer keep up the big garden....so we are doing a smaller garden closer to the house....will not do much this year in the way of canning unless the older kids come to help....I just cant

People in our areas plant gardens as close to the house as possible.. We have pesty deer and bear, rabbits are a big issue as well..

The Peter Peppers I have in our window are growing healthy......
