Kansas Work Comp Rating
Hello,
I am involved in a case regarding my lower back. Not to get into the boring details I have a quesiton about ratings. I have reached MMI and the work comp Ortho. Surgeon has released me. The WC Carrier wants a demand letter from my attorney. Well the WC Carrier has not and it appears will not get a rating report from their doctor. Has this happended to any one else? And what would be the reason for the carrier not getting the report but wanting to go ahead and settle? I know that the WC Doctor put in his med records that there is not hope for helping me with surgery. Maybe they are afraid of the rating? Just wondering if anyone else has had this experience. From what I have read on many sites and my attorney agrees, most Carriers want that report to settle. I am getting my own rating this week. Any replies would be appreicated. Thank you |

they may wait until your rating comes in.
or they may have had a conversation with the ortho doctor and don't like the opinion. |

Of course they will not tell me what it is or even pay for it myself. Even the office of the doctor is confused as to why they dont just get it. Oh well I am confused, but I guess I will let my attorney handle it. Thanks for you reply |

Your attorney should be able to get a copy, as that is part of the discovery process in the WC claim. Don't worry yourself about. It's a process that takes a bit of time. It doesn't really matter whether the IC pays for a copy or not. If they don't want it, that's their problem. Your attorney will need it to have a starting point to negotiate.

I am getting my own rating on the 8th, so after they see what my doctor has to say, I am sure they will get their docs rating to counter. |
