Dilocated my knee at work..

Ok so I was at work, working when i dislocated my knee.. it wasnt my fault, I work with water and washing of buses..
so when there is water on the ground you cannot tell were these holes are.. ok.. it was bad.. real bad.. hurt bad to.. this was yesterday, 11/29/11 Now im new to workmans comp, but as i was laying there on the ground.. my boss told me i wouldnt be fired.. and he would help me with the workmans comp.. I over heard the mechanic talking to my boss also as i waited on that they needed to fix the parking lot.. so what do i need to do? where do i start.. what can i expect? after reading these im scared because i need my job.. what kind of settlement can i expect? just some general help would be great.. I dont like to be in the dark on things and since ive never hurt my self at work before this all new to me.. p.s. this happened in California.. |

you need to file a claim with your employer.
the form is here: http://www.dir.ca.gov/dwc/DWCForm1.pdf give it to your employer and keep a copy. you need to get treatment thru the carriers Medical Provider Network. if you are taken off work it'll take a couple weeks to get the first disability payment. you can protect your job for up to 12 weeks by claiming FMLA more here http://www.dol.gov/whd/fmla/ general information about comp in california is in the factsheets http://www.dir.ca.gov/dwc/iwguides.html |

i think you need a doctor first.
these "horror" stories are a miniscule number of cases compared to the hundreds of thousands that go well. people don't come here to post the successful outcomes so don't judge the system by these few. |

Hello and welcome,they are both right 99.99% of WC cases run smooth with no problems its us few that seem to fall thru the cracks there is no blood and gore no broken bone sticking out of the skin to prove our injury....but there are enough of us to keep a boat load of lawyers in big houses and cars and judges fed real well....its the injured worker doing without....if they are able to fix you back 100% you may get no settlement workmans comp does not pay for pain and suffering just to fix you and lost wages...so keep that in mind if you get thru this and dont loose your marriage,home,car and the clothes on your back you will be one of the lucky ones.....start now by getting rid of anything you dont need ie showtime,HBO, eating out these little things add up.come on over to the Off topic forum for more fun topics good luck
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....
