what happens when your out on comp. and the company you worked for lays people off and has no work for you to return to when the time come? or your old position is now gone or they only want you part time cause of the economy
can i go from comp. to unemployment if my job is no longer there???(Massachussettes)

You would be eligible to continue TTD (temporary total disability) benefits, since there is no job to go back to.

WC is State-specific. It would be wise to post your State, so someone can give you a more definitive answer.

It is possible, but as long as you have WC benefits, it might be more beneficial to continue with those. WC benefits are not taxable, whereas UI (Unemployment Insurance) is taxable as ordinary income.

Even IF you were eligible for UI, they would take an offset for whatever WC benefits you draw, as you cannot draw full benefits from both.

thank you so much! very helpful. i am still on wc and i am def not cleared to go back to work yet. have way too much time on my hands and my head is spinning worrying about my future. the pain is wearing in my stress level. and my boss called to check on me and told me work is slow and they laid people off and it loooks like i am not going to have a job to return too. so of course i am freeked out even more now. i will check out the site you posted.

What you have to remember, arrow, is that not having a job to return to happens more often than not. Even if you reach MMI (maximum medical improvement) and the PTP (primary treating physician) places work restrictions on you, the employer is not obligated to create a job for you.

I can give you one tiny bit of advice.......don't anticipate anything. You'll have enough headaches without imagining what MIGHT happen.

Stay on the WC payments, as they are not taxable income. Reserve the UI for later when you may need them once you're better and can be released to work.

thanks. i feel a bit better atleast knowing that after wc is done and my injury is healed, that its possible to get ui. i was worried i would not recieve any financial assistance when healed and have to scramble to find a job. i guess i can relax a bit and work on healing and not my resume Smile
