ugh! replaced?
what happens when your out on comp. and the company you worked for lays people off and has no work for you to return to when the time come? or your old position is now gone or they only want you part time cause of the economy
can i go from comp. to unemployment if my job is no longer there???(Massachussettes) |

You would be eligible to continue TTD (temporary total disability) benefits, since there is no job to go back to.

WC benefits are not taxable, whereas UI (Unemployment Insurance) is taxable as ordinary income. Even IF you were eligible for UI, they would take an offset for whatever WC benefits you draw, as you cannot draw full benefits from both. What you have to remember, arrow, is that not having a job to return to happens more often than not. Even if you reach MMI (maximum medical improvement) and the PTP (primary treating physician) places work restrictions on you, the employer is not obligated to create a job for you.
I can give you one tiny bit of advice.......don't anticipate anything. You'll have enough headaches without imagining what MIGHT happen. Stay on the WC payments, as they are not taxable income. Reserve the UI for later when you may need them once you're better and can be released to work. DISCLAIMER: I am not an attorney.
