FMLA paper work should be filled out. That is important. As for the Leave of Absense goes, I would not worry too much about that. No matter how you think, the employer has every right to put you on FMLA, just like you have every right to use it when needed. That is a Federal Law and Rules, which is way different from State Work Comp Laws and Rules.

I think you should check with a workers' comp. lawyer, just to be sure that your rights are protected. Also as stated in one of the earlier post, look at your state laws and regulations, you can also access info at the top of the page by going to the info by state tab. I also agree that if your union, check with your steward or the union itself as to thier rules.

Good luck and don't wait too long.
