The Insurance Company wants me to sign this......
Hello everyone,
Brief summary, last year I had a 'work injury'. Earlier this year I had a 'home injury' that is unrelated to the work injury. I am currently collecting Disability benefits, and the disability insurance agent sent me a form to sign in regards to paying back extra monies (a "reimbursement agreement"). The form reads as such : ... with respect to SS benefits, benefits payable under this plan are to be reduced by any benefits under the SS Act that I or my family members would be entitled to receive resulting from my disability... ... should my claim be approved, I request that (INSURANCE COMPANY) postpone reducing benefits... until I am awarded SS benefits or complete the SS application process... ... I agree to make timely and diligent pursuit of SS benefits up to and including ALJ. These steps may include : A) Application for such benefits B) Appeal at 'reconsideration' level, if denied C) Appeal at ALJ level, if denied (There's a few more lines that pertain to IMMEDIATELY paying back the IC if SS benefits are awarded). I'm young enough that I don't want to apply for SS now, for fear that when I am of age to collect SS benefits, that this episode of my life (and any subsequent SS payments) will be used to base my future benefits on. Anyone know if this is a standard IC form ? And am I required to apply for Social Security as part of the LTD process ? Any input and advice is greatly appreciated... |

I would read my disability policy contract to see what was agreed to at the time of your purchase of disability insurance.

Something I just noticed on the form they sent me... Everywhere that the form mentions 'Social Security', it makes no mention of "Disability". It concerns me that, because Disability is not written, this may refer to 'regular' Social Security. And I read all the time that if something isn't in writing, then it doesn't count. I just want to be sure I don't screw myself when I retire later in life by signing this now. Any thoughts, input and advice are greatly appreciated... |

i think their policy has an offset for SSDI and this form commits you to pursuing SSDI benefits.
hence: ...entitled to receive resulting from my disability... |
