Emotional breakdown work related
I never thought I would be here seeking answers to this dilemma . I am wondering if workman's comp ever covers a work related stress breakdown on someone who also has Epstein Barr? I have been seeing a counselor for about 2 years (and so have 2 others that I know of)all related to job stress. Over the past 11 months there have been other stressors in my life that have not been minimized by my boss. Basically, that's too bad, you are doing [/size][/font]fine now do your job. Nice person, with no leadership skills whatsoever. Small town, no other jobs in my field available without moving, which I have been try to do. Sadly I am not the only one in this managerial position, others are & also have medical issues. I am seeking advice on what to do with this situation.

Sadly, a few States specifically limit or exclude "psych" claims, unless they are directly related to an actual physical injury. Not ALL States, but a few.

In order to properly assess your situation, others would first need to know what State your claim would be filed in. You might also want to be a bit more specific as to what is causing the stress. It might help others help you.

I wouldn't lean too much on the presence of EBV as a culprit or contributor to any job-related stress, though. It's fairly common in about 85% of the adult population between 25 and 40 years of age. EBV is sometimes aggravated by stress, not the other way around.

My neighbor filed a stress claim and she told me that they try everything they can to prove its from some other issue and the PI where following her in helicopters and searching her car while she slept. She just dropped the case because they where harrasing her.

I don't think the value of the claim would justify the hourly expense of renting a helicopter; there's just not that much money in workers comp.
average about $1500 hour for general aviation turbine.
and there is little guarentee that they'll find anything that will refute the claim.
How can helicopter photo's disprove psyche symptoms?

Max, I read the detailed account you sent to me directly. What you're describing sounds a bit extreme, but probably not much different that what happens in a lot of employment situations. The economy alone is to blame for problems with equipment, resources, and scheduling. Employers are expecting much more for much less all over the country.

I don't see that your situation is so isolated as to formulate a psych claim on WC, but you're certainly entitled to give it a shot.

Personally, and no offense here, I think you're over-reacting.
