I have been telling my husband that he needs to leave medical open when he finally settles. Yesterday the attorney told him he felt it was best as well.

If we persue a third party case how will that effect paying WC back? If we settle for lump sum and medical we have a amount. If we leave medical open we will still have claims. Regardless, I will still push for it to be left open.

You definitely need to leave medical open, especially if you anticipate expenses in the future.

WC will have subrogation rights against a third-party insurer, but that can be negotiated, so that not all of the benefits paid will be reimbursed to WC.
