I need help PLEASE

Hi All,
I live in Kansas and have been off work since 2007 and I will never be able to work again, This work comp (ins) has done everything in the book to mess with me, we are in the late stages of settlement.
I have to see my Doc. every month because of the paper script's that I have to get, last tuesday I went to my appionment and things went like normal, a couple hours after I had got home I got a call from the Doctor's office telling me that work comp had called them and told them I no longer can make my own appointments!! i called my atroney and he has called them 3 times and the W.C. lawyer won't call him back. 2 years ago I lost my doctor that i was seeing and allmost the same thing happen and I went threw with draws and they were so bad I thought I was going to die. I don't think I would live threw it again!
I would be so great full for any and all help!

Is this YOUR assessment, or that of your treating physician ? An injured worker cannot decide that they will never be ABLE to work again. Whether you WANT to work or not is your call, but making that decision comes with consequences (i.e., no income). Unless you are deemed to be disabled, with a rating that is sufficient to provide you with a disability benefit, the Court will rule that you are able to work in SOME area.

That's because the only purpose for the appointments, from what I gather from your post, is to obtain prescriptions. WC is paying for the Dr.'s time, so they have a right to regulate your appointments. If he is not treating you, but simply writing prescriptions, that can be done without an office visit.

It sounds as if you need to get weaned from the narcotics before your addiction becomes unmanageable. Perhaps have your attorney get you referred to Pain Management to replace or reduce your reliance on narcotic pain medications.

These things take time. You apparently have gotten your written scrips from your last visit, so what is the urgency ? WC has specific "response" times for certain things, but returning a phone call isn't one of them. Let your attorney handle this.

I have been on S.S.Disablity for 2 years. And I could of filed back and got it from Dec 2007, I have no life as it is, I have 3 torn dics,L2-3,L3-4, L4-5, I would trade my back and any money that is due for a good back and be able to work again! I know there are lots of fakes and that is what is wrong with our system right now!! I could give you at least 50 name's that you can call and they all will tell you that I allways had 2-3 jobs all my life. This ijury was done Oct 2003, other than Doctors visit's out of town, because I made my appoinments with my Doctor after work, I only missed 1 day of work from Oct.03-Dec.-07, so I think my record will state that I never wanted anykind of free ride. I am sure that W.Cins has certan rights, BUT don't I, why Do I have to go threw extra pain, ect. If they can do this, that proves to me that there is no justise anywhere, and is just like the rest of our goverment.

No, I don't want a new Lawyer, it isn't his fault that W.C. won't answer his calls!
I was just wondering if there was anyone in the state goverment that I could contact that had the power to tell that Attroney not to be doing that.I need to see my Doctor every month, I don't just walk in and tell him what I need, for some reason, I don't think that would work! W.C. doesn't care if my kidneys shut down because of certain meds I take. My case may be differnt that most ? I do know! All I know, is that I am not allowed to speak unless I am asked a question.

I can certainly empathize with your situation. My wife had severe damage from L2 through S1 with fixation and fusion. Her injury was a rare "spiral" herniation at all levels, which was expected to confine her to a wheelchair. She actually weaned herself off 7 different medications, 3 of which were narcotics. She takes ONLY aspirin twice a day.

Dealing with the pain had to do mostly with not surrendering to it. Sure, she still has pain, and it's predominantly chronic (all the time). So, if this elder (mid-50's) frail little lady can do it, I'm betting you could too. She still doesn't work, but can do a lot of things that she thought she'd never be able to.

Simple answer - NO. If you are represented by an attorney, nobody is going to talk with you about your claim. By law, they can only speak to your attorney.

Then why didn't you ? If you were out of work and MMI in 2007, you might have been considered disabled at that time. If you were still treating up to 2009, then likely you would not have been able to claim those benefits back to 2007. Only your SSDI attorney would know that.

As you've been told. Leave this up to your attorney. I'm sure the WC Attorney isn't ignoring your attorney; he's probably just as busy as any attorney working in the WC system.

welcome to our forum..some of the people here are no nonsence and will give you the answers you seek cut and dried as 1171 and leglegl have. and then you have the rest of us that arent so cut and dried.....there are other things you can do but they may or may not help and your lawyer may not be happy with you so please run them by him first.....can you use your medicare to see your Dr? have you been on SSDI for 2 years yet? if not here are a few of my Favs.....Local TV sations love human interest stories contact them and ask can they help you get your meds from the big bad insurance companies.....do contact your state reps and congressmen and women....write letters to the editors of local newspapers.....all these may or may not help but at least you feel as if you are doing something.....One thing you may get more help with is your SS office they really dont like paying for medicare when the WC is supposed to be paying for it and may go to bat for you....
This sit and wait stuff is very hard on those of us who worked hard all our lives...good luck and come on over to the off topics and hang out for some fun....

I was TAKEN OFF WORK, I didn't take my self off, I never got a penny from work comp from Dec 07-- untill Nov.08-NOT a penny, they have stopped me from doctors care, they had stopped my pay for no reason several times, I have NOT seen a penny from them since Jan.09, they have done everything they can, thinking that I am just going to stand up and say i was just faking it
No one can feel my pain, and I have the Disc O Gram report and the MRI's ect. and I came on here just to ask a question and right off the bat I am attacked and call a junkie!! What did I ever do to you that attacked me????????????????????????????? The Old Saying. You reep what you sew!! There is a person in my town that is 20 years younger than me, worked very little in his life, but his wife has allways worked so he sat around for 3-4 years playing hurt and the day he got his SSD and his back pay, he went and bought a New Motorcyle and a all most new pickup, every day the weather is nice he will be out riding his motorcyle smiling and waying to everyone.
Because W.C. did not pay me a penny from Dec.07 untill Nov.08, that was the first, I was forced to sell my 1986 Corvette Convertable totaly restored, I was the second owner, when that money was gone, I had to sell my 1978 Harley FLH totaly restore and I had nothing else to sell, I guess I was lucky that I had credit cards.
I have not posted this to fight with anyone, but I have been threw it, and I know, that is why I asked the question. A injure person with our without a attroney, you are at the mercy of the other side and there are no rules they do what they want to. I have been going to the same Doctor that I have now for around 2 years with monthly visit's, now they want to make the appointments, you tell me WHY NOW! Just another attemp to harash me!!!

Hey Buddy I am not gonna fuss with you if it wassnt for my drugs I couldnt get thru the day...and like you we darn near lost it all...Thank God I wasnt the primary bread winner or we would have lost our farm as it was we lost everything else to include our credit rating....as I also didnt get a check till we settled....come on over to Off topics....we embrace our broken bodies and accept the fact that we will have to use drugs to exist for the rest of our life....

Nothing in my post was aimed at you. I would love to be off these drugs but like you I couldn't make it threw the day with out them. I am or was the bread winner in our home. I just can't understand how W.C. has so much power!! there should be a law that would protect the injured person from the crap they pull!! Like I stated I was Taken off Work, If someone came up to me and said I can make all your back pain go away and all I would have to do is ride on the back of a trash truck I would do it in a heart beat! I want my life back so bad and I know it will never happen.
I have never attacked anyone about anything, I am not that kind of person!
