RE: Advice
I live here in Md and date of injury was april 09. Initally the insurance company was paying TTD until july the abruptly cut me off for no reason. My injury was a slip and fall slipping ny dick in my lower back. MRI indicated bulging dick and cutting my fluid off. Well fast forward 9 month and 2 IMEs later. Both IMEs said I had no injury and was out of my mind. I mean they literaly threw me out of their office. I at this point could barely even walk 10 min. At this point no money comming in at all zero frickn zero. My health continued to deteriate to the point of not being able to walk at all. After 2 days of being paralized and not able to pee, poop, or had no feeling below my waist my mother rushed me to Johns Hopkin Hospital emergency room. I was in so much pain i was laying on the floor of the emergency room (yuck I did not care). They catherized me and could not belive how much urine I had in me. I was rushed into emergency surgery. holy crap i was in tears and so was my girlfriend. After surgery i could not walk for 2 weeks and was knub all over my lower area in weird places. I wish i could explain more but gets too long. Fast forward june 2010 out of surgery and still not able to pee, poop or feel anything in my butt, legs and toes, although I stared to walk very slowly. After PT and time I still have knumbness in the crack of my butt (very weird feeling) My peins is numb can get errection but really for what. Catheterize twice a day for urine retention. Not to mention I still have back pain not just an academy award but real crappy pain. It is now sept 2011 and my doc gave me 78% disable and the IME doc gave me 57% disabled could not believe they both aggreed. My real question is I should get pain and suffering because this injury is their fault not mine. i wish I could sue but my lawyer seems a bit lazy just runs through the motions. I mean I am commited at this point in time, but he just isnot aggressive enough for me. The insurance offered me 208,900 for future medicals ha ha I am 42 they rated me for 48 and said i will live to 78. Good to see they know what I don't. However on the front end I want him to ask for at least 300,000 I am a level 3 and have gone through hell. Had a WC hearing for oct 5 but they rescheduled because they said the lawyer is on vacation. Bull S#@%
Is 300,000 a realistic expectation and I want to get at least 400,000 for medicals befor I settle anything. With the health care the way it is I am scared but in 2014 won't insurance companies have to take you no matter you pre-existing condition. this is a long post but any advice would be helpful thanks for reading my story

RE: Advice
There is NO pain and suffering in a Workers Compensation claim. You also cannot sue the Employer - WC is your exclusive remedy.

RE: Advice
Hey guys, so I think my next move will be to fill out a ca-7 for a scheduled award, and turn it into owcp/dol. Should I get a lawyer at this point?

Absolutely. You may have benefits that you were or are entitled to.

RE: Advice
My sf-50 indicates a couple of things that I need help deciphering:
- career conditional or tenure 2
- veterans preference = 3
- 5-c code= RUM
- 5-d legal authority = reg715.202 other

How do I use this to my advantage in getting a job with the Feds again?
