how long does it take to get a settlement

i am from the state of NY, i have been waiting for a response from the insurance company on a settlement offer that my lawyer sent in december of 2010, i have been on tpd payments for 2.5 years now i would rather settle my case and just go back to work, does anyone know how long it takes for the insurance carrier to decied weather they want to settle.

i think they already decided.
they only respond when the answer is yes or they think the amount is fairly close.
not answering is a way to say no without increasing the workload.
they don't answer a lot.

also if a worker is really anxious about it they will often make another demand that is even lower.
that way the other party is actually negotiating against themselves.
which reduces the settlement amount without them doing much other then waiting.
it's a standard principal of "winning" negotiations.
I'm sure your atty is very familiar with the practice and hasn't followed up.
