HI.. NEW HERE BEEN ON WORK COMP..FOR 4 YRS CLOSE TO MY SETTLEMENT ATTONERY SAID THAT IT COULD BE DONE IN 30 T0 40...DAYS...THE QUESTION I HAVE IS..THEY WANT TO SETTLE FOR AROUND 150.. BUT AND THEY WANT TO DO MEDICADE SET A SIDE..MY QUESTION IS DOES THIS COME OUT OF MY LUMP SUM SETTLEMENT...THIS IS WHAT MY ATTONERY IS TELLING ME..IS THIS TRUE..

yes the closing of your comp case and a buyout of your benefits includes $$ medical care.

P.S. you should start your own thread and not hijack others; it confuses those that are looking for answers for their claims.

SORRY I AM NEW HERE..NOT SURE I WORD THIS QUESTION RIGHT...MY ATTONERY SAID THAT IF I GET 150..AND MY MEDICAL IS 27..THAT THEY TAKE THIS OUT OF MY 150 AMOUNT..I ALSO THOUGHT THAT THE 27 FOR MEDICAL WAS A NOT GOING TO BE TAKEN OUT OF MY SETTLEMENT AMOUNT..THANKS

the check can come straight to u........ "only if there was no lawyer or 3rd party in your case".
Otherwise...... LeglEgl.... is right..... "you wont get ur $ til your lawyer gets their $"

I didn't have a lawyer in my case and my check was handed to me after the judge signed off on the settlement in court.

Actually it depends on the state. In new jersey one check goes to you, the other to the lawyer. Lawyer does not get the check, take his funds out, then send it to you . He gets his own check separate from WC.
