RE: pain's going away...how do i go about this now?
From the sounds of it, you have two conflicting assessments as to whether or not the "injury" is work-related. This can sometimes cause the ER/IC to deny the claim (controvert). You might want to consider alternatives in handling the medical here. If you have group or private insurance, you might need to go that route if the ER/IC denies your claim even on the medical level.
I am a bit concerned though, that in your initial post you said that your Dr. and PT say this is work-related, then in your recent post, you said that your Dr. claims it will be next to impossible to prove that it's work related. Has he changed his assessment, or is he speaking as to just being able to prove cause ? It usually isn't good if a Dr. starts to second-guess his own assessment. You didn't indicate whether or not the company is paying for medical. If they are, they may have accepted this WC claim as a medical only case. Given that, the medical treatments could literally grind to a halt if they have the MRI showing there is "nothing wrong" and their Dr. says it's not work-related. Either way, I think you're in for a struggle. DISCLAIMER: I am not an attorney. At this point, if you don't have an attorney, I'd suggest you find one and at least get a free consultation. There may be something there that a good WC attorney can do for you. Most have handled tons of cases, and might have a trick up their sleeve.
In the meantime, take care of YOU. DISCLAIMER: I am not an attorney. While drawing from my professional training and experience in law enforcement and as a former Paralegal, no comments offered should be considered as legal advice. |
