100% permanent total disability

I live in NJ does anybody know how 100% permanent total disability works? what the settlement is?? accident happened in 1998 i only received 6 months of temporary disability payments?? I know u don't have to be a quad i only have 1 arm left i am right hand dominant. there is no need to make FUN!!!!

wasnt making fun....WC isnt SSDI they wont hardly give anyone 100% if you have 100% you are one of the few....do you have a lawyer?there is no set dollar amount...WC does not pay for pain and suffering....it is based on the pay you were getting......if you were say like I was and a part time worker or a min wage earner you will get less than someone who made 20 bucks an hr.......this happened 9 yrs ago? many on here are in wheelchairs and fighting to get their medical and pain meds......one of our members was a quad and fought for many years to get his......and still didnt get enough to live on...wasnt making fun of you at all...... honey got 21% disabilty for right arm 15% for his left......he got to keep both arms but has a permanant no lifting over 10 lbs....drops things and has a hard time writting or typing.............

Hi madbiller, welcome to the forum. This is a great forum with a lot of great people. I doubt that anyone would make fun of you. I know that Jayne did not mean it the way you took it.

I am from NJ. My husband is the injured worker however. I went back to the site which I am going to give to you and looked this up. If you are on permanent total disability PTD then in NJ for 1998 you would receive 70% of whatever you pay was at the time up to 516.00 per week and no less than 138.00 per week. As far as a settlement, a settlement would negate any weekly payments that I listed. If you are wanting to settle you best course of action would most likely be to confer with an atty. They could lead you to the best possible outcome. Good luck with your decisions and I am sorry to hear of your injury. Red

100% permanent impairment claims are entitled to disability payments for 450 weeks under New Jersey comp law.

"These benefits continue beyond the initial 450 weeks provided that the injured worker is able to show that he or she remains unable to earn wages.

Wages earned after 450 weeks offset the weekly computation in proportion to the income at the time of the injury. Permanent Total benefits are paid weekly and are based upon 70% of the average weekly wage, not to exceed 75% of the Statewide Average Weekly Wage (SAWW) or fall below the minimum rate of 20% of the SAWW."

The hubby is 100% disabled, a California case, hurt almost 8 years ago, finally got the rating in 2004....been a real big mess all the way around. Had to go to court to get any disability payments, but got SSDI on the 1st try, still get that and a little disability too....they pay for meds and doc visits sometimes when they feel like it. Our atty got paid, but we get sometimey payments....they offered 124000, yep 124000 for a settlement, and we figured it was supposed to be closer to 500,000 so we said no and take the bi-weeekly payments.
I know that may not help you much, but we are disabled and wanted to let you know a little about us.

Hi everybody,
thanks for the info. this is what i was told by a lawyer that u are entitled to an award plus your monthly total disability payments. in my case they only want to pay me my disability payments that is it. so all i get is 800.00 a month until the day i die. it can't believe worker's comp is getting away with murder!!I should be entitled to an award also. it's closed medical no medicare set aside nothing!! everybody i confer with tells me something is not right here. HELP!!!
