This way there is no fuss on the offset, knowing I didnt want the surgery.. Well while we go deeper in debt by his waiting game I called him last friday and told him I need to file now. He was supposed to call me tues, and he did while we were napping (Dom and I) I called yesterday and he was out of the office...

You've been given some good advise here.
I too am an advocate for less pain meds, more home therapy. I know how it hurts to exercise when you hurt and sometimes it isn't even possible to take a walk. I highly recommend water therapy for someone in your situation. You will feel better, lose weight, and with time might be able to start weaning off some of the meds.

I had to "stop" most of my meds in an instant when it effected my kidneys. That was a "blessing in disguise" for me. Once off the meds (except for depression/anxiety) I felt a whole lot better.

Ask your doctor for a gym membership with a pool. I was allowed 6 months paid by WC for a "self-directed" gym membership and I used it almost daily. Then I had a Spinal Cord Stimulator implanted and when we tried to renew the membership thru WC, they denied the request. It seems like when something works for me, WC denies it. LOL! I purchased a spa for home use, and have weekly physical therapy, all at my own expense. My feeling is I am going to do whatever I have to do for my own well being.

Your Attorney can get 20%(using Louisiana fee) of the MSA off the Indemnity portion of your settlement. For instance you have a $100k Indemnity settlement and a $100k MSA. Your Attorney gets 20% from the Idemnity AND 20% of your MSA from the Indemnity.

Now Your Attorney can choose not to take 20% of your MSA BUT most of them greedy turds will get all they can. Now he cannot get anything from a open medical settlement but most IC will not choose this route and your Attorney does not like this Route.


I know this because I have been through this in my state. I guess it is possible your state over rides this.

Also at 41 years of age, you wil have a battle getting SSDI unless you have a really bad....
