As I read it, (and I'm no expert), CA SB 899 addresses separate injuries to the same body part as well as to different body parts. That's all fine, but where can I find information that addresses different injuries to different body parts at different times. I had 2 injuries to 2 totally different body parts that resulted in 2 separate percentage ratings for each part in 1999. One rating for bilateral feet and another rating for an arm. Fast forward to now in a third unfortunate event I have injury to a third different part of my body. I assume that at some point I will get a rating for this new injury (TBI), but what I can't understand is how they will calculate one total percentage that factors in 2 pre-SB899 ratings with a new post-SB899 rating. My head is spinning around this. Anything will help. Thank you all.

RE: ??Apportionment and CA SB 899??
They won't.
Since the ratings and restrictions don't overlap you'll have a third separate rating. Whether injuries overlap and require apportionment is a medical determination. |
