Settlement 6/28/11....
The IC attorney stated that I would have my check within 10 days....here I sit and no check yet. Is it common for PA IC to take the whole 30 days to pay? I even signed the waiver of appeal in order to expedite the payment process and still no check yet. Also is it calendar days or business days? Cause that make a huge difference.
Thanks

We are not permitted to diclose the names of the IC. But unlike you I was in mediation hearing on a Thursday and back in front of a judge the following Tuesday 6/28 to sign papers. That day the IC lawyer told me "Mrs-------, your check will be to you within 10 days" lol yea ok. Also I signed the waiver for appeal which states the time is cut to 20days for payment. Well......still nothing. So now what? How long do they really have?

Double check the language in the agreement and see if the 10 days is spelled out in the agreement. In addition, if your lawyer asked during the hearing whether you were waiving your right to appeal in order to receive your money more quickly, that could have some impact. And of course, talk to your lawyer and see what he thinks.

My husband had his settlement hearing on May 18th, our check was cut on May 20th and we had it in our hands May 23rd. Our judge signed a bench order I think, not sure if that makes a difference? Our lawyer said usually you have to wait for the judge to approve the settlement and send the copies to everyone but said that a bench order is binding so they can pay him based off of that.
