CMS approves MSA
I received documentation from CMS that my WCMSA has been approved. I "might" be close to closure after 8 years.
Honestly, I am cautiously optimistic that the IC will accept what CMS approved. IF they do, Halleluiah! 2011 Lexus Convertible |

freebird I received my letter last month that my MSA had been approved by CMS.
Two days later I received a letter in the mail with the notice of a settlement hearing being scheduled for the following week. I wasn't very happy about my MSA being approved and received threats by the insurance company that they would take me to court if I did not sign off on the settlement/MSA. I gave in ans signed off on the MSA, now I have my exsupervisor from work following me aroung town. |

Freebird I hope for your sake you are nearly done it is a freeing experience to have them off your back.....Bummer invite her for coffee....
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

You have settled right? I would have someone arrested..... I am "good" with the MSA amount. I agreed to this amount BEFORE It was sent to Medicare (CMS) for approval. The biggest issue I face is Lyrica is currently not covered by Medicare which means I cannot use my MSA to pay for Lyrica. The cost for me is $approx. 280 a month! I have to try and find a alternative. Now, The IC has to accept this MSA or we have no settlement. We will see. I think they will and things will move fairly fast. To say I am stressed and nervous is so true. After 8 years of fighting this monster for my rights as a IW, I am tired. How many years does a drug company have before a generic can be made for it? does anyone know? is it close for lyrica?

I had a family Doctor tell me 2 years ago that Lyrica would take probably 15 years...... He explained why and I honestly did not understand a damn thing he said. LOL 2011 Lexus Convertible |

The patent for Lyrica currently expires in October 2013. This is the earliest possible date that a generic version of Lyrica could become available. However, there are other circumstances that could come up to extend the exclusivity period of Lyrica beyond 2013. These circumstances could include things such as lawsuits or other patents for specific Lyrica uses. Once Lyrica goes off patent, there may be several companies that manufacture a generic Lyrica drug. |

Second try, If Lyrica can be kept as an orphan drug, it would be a min of 7 yrs before another company can even apply for an application to start any drug trials. FDA made this ruling stating No drug manufacter would even consider coming up with an orphan drug, as they would lose money, as not enough medication would be sold to show a profit. So for the sake of us, the FDA made this ruling. Even if a second drug would be safer or more effiecient. I know my Provigil is over $1700.00 a month. Lucky us.
