Have you looked at all the rules and regs for Longshoreman WC?? If your employer is controverting your claim, it sounds like it is time to saddle up and hire an attorney that can help you prove what the actual injuries were in the first place and begin dealing with all the headaches like non-treatment for your injury/ies. Leaving you with the ability to begin to heal.
When you were first taken off of work, did you receive any kind of monetary compensation to replace the funds that were lost from not being able to do your job ?? If not, then it means your employer controverted your claim within 14 days of the injury.. yet, it sounds like you recieved medical treatment for the injury .. which wouldn't have happened if they controverted your claim. So that part is a bit confusing. Have you begun to look for jobs within your restrictions?? It sounds like you would be eligible for unemployment benefits while you look because your employer let you go. Unfortunately, longshoreman WC is a very different critter than regular WC by state. We could give you an answer, but from our standpoint, we are all clearly uninformed on Longshoreman WC.
