Hey y'all long time no see. I haven't been here in a few years Shy but would like to update those that may remember me from 2007. My state is still Georgia.
I have finally had a resolution to my WC claim. I did a stipulated settlement for indemnity and kept open life time medical.

I did finally get SSDI approved 10/2009 and due to that the IC did not want to meet the requirements that Medicare be protected with the WCMSA as it was nearly 3/4 million $$$'s. However with a very astute and top notch attorney my indemnity was very much to my satisfaction and I only gave up a few weeks of TPD money to get the stip agreement accepted.

Just wanted to drop by and say HI to y'all and hope all is well.

I would also like to be able to help others that are NOT familiar with the various laws for WC. Over the past four years since my injury I have had a great deal of time on my hands to research and have learned a great deal about WC laws in various states. California is one of the exceptions as the WC laws for CA are hideous and more complex than any other state I have read up on, IMO.

welcome I do not remember you but will be the first to admit my memory isnt what it used to be...

;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....Smile

Thanks for the warm welcome Jayne and NO problem with the memory thing. I think we all have some memory deficits from being injured and some of the medications many of us are on. I signed up here back in 2007 a few weeks after my injury. Have had a very LONG and hard row since then as far as recovery goes. Even after two surgeries and so may PT visits I have lost track of the count, I still have tears in my rotator cuff and will more than likely one day end up with a total shoulder replacement to actually fix the darn thing.

The IC has pretty much followed the law as to providing necessary treatments, (although they did take their dear sweet time getting my surgeries approved). And they did agree to a fair stipulated indemnity settlement.

They just were NOT willing to set up the WCMSA necessary, as due to this work injury coupled with some other pre-existing medical issues, I am also on SSDI with Medicare. I guess their thoughts are they will take a chance of me getting run over by a bus rather than to allow me the freedom to oversee my own medical care.

I do feel fortunate as so many other IW's have had to fight tooth and toe nail to get even the most basic medical treatment, in spite of what the WC laws provide for.

I recognize many of the screen names even though it has been so long since I posted here.

we sure could use more help on here so many getting hurt and no place to turn for help....so many afraid they will lose their job....its a scary world out there....

Thanks both of you, Jayne and Bummer Knees. It is good to be back and in somewhat of a position to help others. As I now have more time on my hands than I care to think of. We, my hubby and I, recently had to move from our home of over 15 years due to foreclosure and are still trying to get all the accumulation of junk unpacked and or discarded. Looking forward to hopefully being able to help those that are newly injured and looking for answers to their questions.

welcome back ND, I had that garage/moving sale last August, spent a week in bed, got up the day moving truck arrived and broke the other ankle, so be careful, lol!
