Knee re injury in Texas
Some years back I fell down the stairs while carrying a box at work. I sought treatment for a twisted ankle and knee and did physical therapy and was released back to work. I re injured the same knee at work picking up a box a couple of years later. Something inside my knee snapped. I sought treatment which led to knee surgery. I was out of work for a month, did physical therapy and was released to go back to work. I do a lot of kneeling, squatting, and lifting at work. Last week I was working on the floor and sat "indian style" several times during the day while stocking and moving merchandise around. I guess this aggravated my knee. This weekend my knee started to bother me and by Monday I was wearing a brace. I called the physician who did my surgery and they told me worker's comp is a lifetime thing and I needed to go to the doctor who first said the injury was work related. I thought this was silly and never intended to file a claim for this current knee trouble even though it is starting to feel like it did when I needed surgery. I talked to my boss and said maybe I should just find another doctor and not tell them about the injury occurring at work. My boss said if it was work related, I should go with wc, but asked someone in that department about it to find out for sure. They said to find another doctor because it is not wc. My husband says if I would have never hurt my knee at work to begin with it would not be bothering me now. I feel silly about claiming it as wc because no one asked me to sit that way at work and I can't pinpoint the moment or even the day the re injury happened. I have worked for the same company for 14 years and don't want to cause them any trouble, but now I am starting to wonder if it is wc? That was an expensive ordeal last time with the surgery and therapy and all. Is it wc?

It is not the companie's choice whether or not it is cover by WC.
I would seek medical attention and tell the dr. what you think happened ( what you think caused the pain to return ). The dr. will decide it there is a connection between what you tell him/her and work. If there is no connection, then there is no wc claim. If there is a connection, then there should be a wc claim. I would recommend calling the treating dr. ( also known as the dr. of record ) and let him/her know what is going on. YES, medical for the original injury is for life in the state of Texas. 8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins. Soilders died for our freedom. |
