Hearing tomorrow on the MSA
I have a hearing tomorrow afternoon of the MSA.

THe MSA was approved a week ago by CMS.

THe amount is a joke, $4,613.00 for life. The settlement papers read the if the MSA is not approved I will have open medical.

The proposed MSA includes x-rays 4 times in my lifetime, and going to the doctor once yearly, along with paying for one MRI of the left knee.

I will go thru the amount reserved for the x-rays in 4 years as the doctor does a series of x-rays at ever appoinntment.

I want open medical and will tell my attorney so, yes that means keeping work comp in my life. Mine is not a healthy knee and will likely requre additional medical care other than doctor appointments.

Good luck on your hearing and I hope you get what you need.
I too have a hearing tomorrow for termination of course. Crossing fingers for both of us. Smile

Diagnosed w/ SI Joint Dysfunction. Moderate to severe pain daily. Limiting most functions.

I know we all would like to be done with WC but in your case it does sound like that is not going to work for you. It sounds likes they hope it will work out to be cheaper to give you open medical then to try and figure out a fair amount for the MSA. Good luck

I believe I would stay open medical also

;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....Smile

Being a MSA cannot be resubmitted after approval by CMS I also would refuse the MSA and go with open medical.

They low balled you and want you to accept this to get you off there claims list. They figure most will do anything to shake WC but they made there bed; They can lay in it.

MY attorney said he would go with whatever I wanted. He talked to the attorney for the insurance company and told them I wanted to keep the medical open vs the MSA, then the threats started. They threated to take me to court and force the MSA, said I had signed some papers.

So I bucked and agreed to the MSA.

I am no longer in the work comp system.

Damn, I dread going through all of this. My MSA arrived at CMS Feb.8,2011; I am still waiting on CMS
