denied because of pre exixting injury
I recently hurt my wrist at work and after going to the companies doctor who said he couldnt tell if it was work related or not, I went to my family doctor, then was referred to an orthopedic surgeon who said I had somehow fractured my wrist when I was a teen or before,( Im 50 now),and now the work that I do has re-aggravated the old fracture. My employer told me that they are sure my workmans comp claim will be denied because it is a previous injury. Is there anything I can do to fight this or am I pretty much out of luck? I live in PA if that helps.

file the claim in writing; neither employers nor workers get to decide whether a claim meets the acceptance criteria.
aggravations are considered new injuries; you are entitled to benefits. |
