when person filing for workers comp dies before settlement
I have an uncle who got a head injury from falling off of a ladder in Florida. Its been over a year and they have not settled yet. Problem is he recently passed away leaving his wife. Is there any hope now for her to get any kind of settlement since he has died? The cause of death was a heart attack but he could not get some treatment or operations to help because he had a Tracheotomy which he had to get as a result of the accident. Any info and suggestions at all are appreciated

did he have a rating or any kind of settlement offer before he died?
was he receiving any kind of disability payments when he died? some states have provisions for due and unpaid disability to go to the estate or dependents. |

I don't know the answer in Florida, but I am willing to bet that if there is a benefit entitlement there will be a fixed time frame within which the claim has to be made. I would strongly suggest that your aunt talk to at least one local attorney ASAP.

In Florida, there are no further benefits unless the death was a result of the injury.
