there are some states that you can file bad faith against against the IC. Not sure what all it amounts to but something that everyone should check into with their own state wc laws.
It's not for the families - but the iw that has to file it, I do believe. And if I remember correctly it's over and above your wc settlement. Just trying to remember off the top of my head.
Sithie, yes this has been going around for many years. In fact I do remember passing that information around for sometime myself when it came out. if you notice there really wasn't all that many people that signed it. I think only close to 400. And we know, we had even sent that out Via E-mail, with hopes to cross the Nation.
One thing is for sure, even like Pooh stated, is if one can prove Breach of Contract, it is the Employer's Contract, not the poor injured Employee's Contract.
Now Bad Faith is way different, for if one has and can prove they been treated with Bad Faith, they can have a good case.
As you seen in the Petion, it does state Class Action Law Suit. One that I myself wouldn't like, for those in it, only obtain a little amount of money, if ever obtained, and the Attorney's are the winners in the end. But that is how Class Action Suits work.
