Red, what you have is already excellent. I was thinking about how the I/C can take so long to decide what an injured worker can do next in treatment. If they make you wait for needed surgery, you may have lasting damage. Another thing is how can the I/C stop sending your ttd checks. I went six weeks without a check and without a reason. I couldn't get a hold of my adjuster, so I finally hired an attorney. He let her know I had hired him and she still didn't send the checks. She (the adjuster) finally said that she thought I was back at work full time. That was said after I, then my attorney told her my job didn't have work within my restrictions. She didn't have any reason to stop the checks, especially the first four weeks. I hadn't even been released with restrictions at that time. I was still temporary total when she stopped the checks. Thankfully my banker understood and said to just pay as soon as I got my check.

These are just a couple of the concerns I have had. I'm not sure if I have lasting damage or not, but I know some others do. With my check, I was lucky. I have a husband that helps pay bills and a small town banker that knows me, but what are others going through?

every state is different which makes it hard to get info for many of us....I believe if WC had to foot the entire cost of our lawyers they would deal with us differently.....and if they were fined for delibertly harrasing and witholding TTD and needed medical care and fined substantually I believe it would go easier on the IW but I believe many case managers are given bonuses to stall and hope the IW gets fed up or runs outa money and has to give up and go back to work even while injured......

That is another thing, how hard it is to find info and then who can understand some of it. If everyone was honest and info was easily found and understood, we wouldn't need lawyers.

KSgirl, Now that is the truth, The reason most IW have to hire an attorney is so they can understand all the legal jargon. The everyday IW can not decifer all that legal stuff.

Ok...I am going to put this all together but I am writing a paper today on the imagine of Nursing for a friend...actually she is going to write this one based on my research and notes. Then I will APA it...and bingo we have a paper...after I have done this with my friend here in New Jersey I will try to get to this one. If not today then tommorrow. ...then off it goes...everyone with me on this...I hope so.. I just believe that their are solutions to all the impossibilities in our world if we just reach out and grab them....and Idealist I know it....love Red

Don't forget about Maury, he seems to like putting outrageous things done to humans on his show. Remember about how some IW have their choice of treating Dr's put under scrutiny by the WC when they don't like their treatment regimen or medicines that they prescribe, etc.

I for one have been paying for all my meds. and sending the receipts to my lawyer, due to the adjuster having my Dr. under review and won't approve any meds. I have my TPD suspended, and my lawyer has had to file a petition to have it reinstated.(still hasn't been reinstated). All this started after I chose a doctor, and started to get results, when their choice of Dr.'s wasn't getting much results. I also had the NCM authorization revoked.

You should also mention how the WC can send an IW to a supposedly Independent Medical Evaluation, but since they are paid by the WC (upwards of $1500.00 for each one), they are very bias and tend to benefit the WC and not the IW. They send IW to work with higher restrictions, and expect them to be able to recover, and don't care if the IW gets worse. All of this from seeing the IW once.
