Disability payments
I was injured in 1995, had surgery in 1997, last payout was 2003. I recalled my attorney telling me that unless I petitioned my income to base and future payemtns would be based on the income at the time of the accident. I had no problem with that. Now its 2011 an I need a knne replacement. Old employer is paying but I have been told by my attorney I am not elegable for any disability payments because I havent filed a claim or petition i the last 5 years. I live and wok in Maryland. Confused.

most states have time limits in their laws.
your disability was fixed and can only be changed within the 5 year window.

I get that, but I dont get that I am no longer elidgable for any ttd payments while I am out having my surgery.

I suspect that the law limits disability in general and not just permanent.
