Red Please check your State's Statute on Medicare set-aside and how long your Husband will have to wait to apply for Medicare. I was told by my attorney if I were to apply for Medicare within I believe 24-30 months of a settlement, they will most likely turn me down and continue to, or at the very least NEVER Cover my injury or any Complications thereof, because of no set-aside. I'm not sure if it's the same in all State's, I know Medicare is Federal, but there may be variations in State Laws. Settlements are all about the wording, every , and . and they will hold your Husband to every Letter written in that final settlement. I'm not trying to make this complicated for you, I just want to make sure that Your Husband doesn't want them gone soo bad that He ends up losing out in the end. Carol...You already know how this makes me feel..as we talked this morning...First I want you to know...it is so hard for me to hear you struggle each morning...with your own health. And you never complain or talk about how bad you feel unless I ask. But you can't hide your pain and struggles in your voice....you are just such a strong women...it amazes me.
Back to subject in hand...I know you tell me being angry is wasted engery...and you are so right. But Carol...WHAT they did to your husband is WRONG....to find out what is wrong with you medically in your Attorneys office...over a year later....and to find out you have some very serious problems....that should of been told to you by the treating Dr in just CRIMINIAL. And not just my one Dr that could of told you...but 2 or 3. But to just be told you have DJD and it was pre-existing....and we the IC aren't going to treat you...never have paid you a dime...was refused pain medications when he stated he was in pain.....Well I can bet he was in PAIN...with all that going on. Then to just be told all you have is DJD....it just makes me more then MAD....that they can get away with this. And they can do this...by shopping for Dr's that will say this stuff. Because if I remember right you have mentioned that they IC have sent Del to several Dr's. So you know just what they were up to. When does these kind of behavior become lieable. I just would think that the Dr that did the first MRI and found the problem should have to tell the patient what is wrong with them....do we not have the right to know what is wrong with us. Carol...I do feel so sorry that you both had to sit in your Attorneys office and hear this kind of news...it had to be difficult. I also know that your husband has made his decision...with his case...and you will support him with what ever he has decided...I know you don't really agree with the decision. But I can also understand your husband wanting WC out of his life...and to just move forward. But I can also see you as the one that just knows you can fight for the right of things....but you are married...and life must go on. You have a wonderful marriage. So I know. You have told me so. I will pray that the settlement process goes smoothly for the two of you. |

Thanks everyone for your support and kindness. I am very disappointment and maybe very angry, I just have not decided who I am angry at or with. It may be me that I am angry with, that I did'n't do more when this was all going down. The good news is that he is now receiving the medical care but not through W/C which is where it belongs. He is very happy with the care he is receiving now, so that makes me happy. This just makes me want to do something to let people know that W/C is a joke. You are not protected at work. Right now I wish I had more energy, I really think something should be done about this system. I truly believe that you can change the world if you just set you mind to it and start the baby steps one day at a time. There is a saying that I like and it goes sometime like this ...... "Nothing will ever be attempted if all the possible objections must be overcome first." I really believe that all of us should make a statement somehow about how this system does not work. It doesn't work. In most cases, if a doctor where this negligent as in my husband's case, we would take him or her to court. However, you can't do this with W/C. Amazing isn't it. Red

Red1030, well you can take a Doctor to Court if you can prove the Diag would promote harm or injury to him.

Red - I didn't read all of the posts, but it sounds like hubby's back and mine are pretty much the same. I will tell you that mine has gotten much worse over the course of the last 3+ years. Being mobile now has become a real issue and the pain is really taking away from my education as I can't concentrate and I don't have much of a memory left. Several times I have asked my atty to settle and always the pain would increase shortly afterwords it seems so I would wind up renigging and begging for treatment again...blah, blah...
I guess what I want to say is amybe send hubby out for a walk around the block or something in the evening after it cools off to see how much pain he's in and if he still wants to settle. I have been trying to do small things and even that is setting off large pain levels. Right now I couldn't walk an entire block for the life of me. I just hope he won't regret this later. I wish you both well and I think I'm kind of rambling so I'll go... Oh yeah (edited to add) my problems have spread to my sacro illeac and both hips as well, this happened over the course of time I am assuming from the limp...just offering info to try and help Luv ya, monster Please click the link below to help provide food for homeless animals. kids i know where your coming from my venting has nothing to do with WC but i cant get it off my heart my friend -she got sick and her bf took her to our local er they got her stable with the old aint nothing wrong song but she didnt get better he took her to the dr office same song he then took her to the big er in the near big city same song so they brought her home he heard a thunp and ran to see her in the floor he grabed her into his arms just in time for her to say im diying tell the kids i love them .what is this world coming to when the mighty dollar is more important than a life ? im sorry but im low tonite sweetcaroline

Oh Sweet Sweet Caroline, I am so very sorry hun. I cry for you and all who love her, and those blessed children. Sweet One, I am so sorry for your loss, Please know she is now in the arms of our Father, with all the lights of Heaven shining around her. Please know you are loved, and I am praying for you and those you love. I will add you to our prayer circle here in my town and will ask all my family to do it in theirs also.

sweet...I am sorry for your loss. And for the family and friends of this lady. Have they found out what was wrong with her? You all are in my prayers.
