Can I apply for SSD?
Hey there Forum! I have question for the pros I know(1171,Old Redneck, Jayne,Bronco)or anyone else. I was wondering if I can apply for SSD or any other compensation? As my freinds here know, I AM getting TTD at the time and just wanted to know if there was other income or disability checks that I can be getting or intitled to? Thanks for your time freinds!

your attorney will most likely tell you to not apply for SSDI...but if you need the funds go ahead...it can sometimes take a couple of years to get SSDI depending on your age and injury.....if you get it while on WC it does complacate the settlement process a bit but that is why we pay the lawyers.....it also lowers the cash payout for your lawyer a bit which he doesnt like either....

That is correct, anyone can apply, being approved is another matter.
Soccial Security Blue Book has the listing of disabilities that qualify. But it is not that simple, a very involved process. Your attorney should be able to tell you if you qualify. I applied 1 year after I was injured, my family simply would not have made it without the extra income. I was fortunate as I qualified within 6 week after I applied without an attorney. |

Are you speaking about SSDI???? The Federal program. There is a difference between SSD and SSDI. Some states have SSD.
Now if you are speaking about SSDI, as Jayne and BK are. You must have been off work for medical reasons for atleast six months and be ecpected not to return to work for another six months. Or have been off work for medical reasons for atleast 1 year. If you fall into that criterea. Then why the hell have you not applied????????? HHHHMMMM?????? I know why, you did not have the info. If you are going to apply, collect ALL your medical records first. As you will find that very benifical. You can apply online ( I believe they provide a check list of info you will need before starting the process). That is what I did (years ago). After applying, you will recieve a letter or phone call for an interview. During that process, that is the time to make sure you dotted all your I's and crossed all your T's. As you have been told, it can be as short as BK's was or several years. There are a few factors that come into play for approvale. In my case it was 3 and a half months. If you are approved. There will be an offset while you are receiving WC. Meaning, the max. you can receive from WC and SSDI is 80% of your pre-injury wages. You would still get the same amount from the WC claim and the SSDI will be OFFSET. Hypothetically, lets say you made $500 a week and your state regs. only allow you to collect 66% from WC. 500*66%=330. And you get approved for SSDI. That means that you would get the $330.00 from WC and $70.00 from SSDI. $330.00+$70.00 = $400.00 a month which = 80% of the pre-injury wages ($500.00). You should get some info from others. There are quite a few here recieving SSDI. Keep in mind that this is the weekend and some will not be back on line untill Monday. Take Care 8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins.
