Permanency Hearing

RE: Permanency Hearing
I agree with the pain scale too. When I went for my FCE i was constantly asked what my pain was. When asked about the 5th time they said "now remember 10 is like your being tortured by having your fingernails pulled off by hot needle nose plyers" (no joke) and I was shocked. Had to tell them that I would liketo go by my dr's scale so it was rated the same way. My dr always told me to imagine the most painful thing I have personally been through and compare it to that. I have this on paper w those smiley/frown faces. He actually wrote this on the paper for me to take w me to other appointments. Everyone deals w pai. Differently so there shouldnt be one general scale. What might be a 7 for lil me could be a 4 for someone with a higher pain threshold.

31 year old mother of 3. Working as Pre-K Teacher. Tripped over leg of therapy swing, twisted and jammed lower back.
Diagnosed w/ SI Joint Dysfunction. Moderate to severe pain daily. Limiting most functions.

RE: Permanency Hearing
The pain scale i use i got from my primary care physician, i found it in her office and asked for a copy, so i now use it for all my wc drs well and any drs as i like it.
ADULT PATIENTS
0-pain free
1-very minor annoyance-occasional minor twinges
2-minor annoyance-occasional strong twinges
3-annoying enough to be distracting
4-can be ignored if you are really involved in your work but still distracting
5-can't be ignored for more than 30 minutes
6-can't be ignored for any length of time, but you can still go to work and participate in social activities
7-makes it difficult to concentrate, interfers with sleep. you can still function with effort
8-physical activity severly limited, you can read and converse with effort, nausea and dizziness set in as factors of pain
9-unable to speak, crying out or moaning uncontrollably, near delirium
10-is just a black line
this is the scale i use and i am always at a 8 starting out my day and as day progresse it does come up to a 9, and i have had days that it is a 10 or higher, and i rate a 10 for me as kidney stone level pain, but kidney stone pain is usually only in my back and lower torso. So some times i go competly off the pain scale with it being a 10 plus
But this is what i use, anyone have any more they can add or change on my pain scale to help me understand it more easily???

RE: Permanency Hearing
Thanks CF I have printed this out.

It is amazing how the pain scale differs with doctors and Pts.

My docs have me at 100% and the IC docs at 50%. I need 75% or better to get the max. The time seems to go so S L O W when you're waiting for something
Wish me luck

i am no to this site but have a few questions, i have been receiving ttp from workers comp for 2.5 years now for my lower back and knee, iwas sent to ime for permancy back in march of this year there md said that i have a moderate ppd my md is saying 100%, i am not expected to have surgery my diagnosis is sprains and strains, my question is how long did it take for you to get a permancy hearing, and did they offer you a settlement.

RE: Permanency Hearing
Hello Norma
I was injured in 2005. I had 2 surgeries, one being in 2007 for a double fusion with instrumentation in my neck. My other surgery was after I went back to work for over a year and herniated more cervical disc's. Had another fusion which never actually fused. I was granted SSDI in 2009 and had a WC permanency hearing in 2010. I was awarded 75% from the WC judge back in February I believe which would give me my full lifetime benefit. The other IC appealed the decision so now I am STILL waiting for the final verdict. As I wait they are holding back 500.00 a month from me
The WC Judge had asked for a permanency hearing back in early 2009 and when both parties dragged thier feet she made the decision of 75%. My doctors have me at 100% and the IME has me at 50%
I hope this helps. I am a volunteer fireman so my WC is slightly different then average WC cases.

RE: Permanency Hearing
Hello all
I haven't been on in a while, trying to stay away from the computer chair to see if it helps...NO it doesn't Sad
Anyhow I had a permanency hearing back in March and was getting antsy as to the status so I finally decided to call the attorney. Turns out the day I call is the day the decision to uphold the judges order in my favor was given. Go figure. I am so happy the waiting is over and only hope the IC has to pay a big penalty for holding up what was rightfully mine.
