settlement question
I would like to explain my question in another way so someone might get a better undrstanding of what i am asking, thank you in advance for your patience.
1. claim was in MD i collected temp total payments while injured with no serious proplems. 2. I reach mmi 4 years after i injured my self then im sent for a rating after i received the rating the lawyer applied for a hearing we went to court and i was told that i was permanently partialy disabled also the judge awarded me 225 weeks of payments for my permanent partial disability / rating for x amount of dollars that maryland allowed acording to my rating that also included atterney fees from the award. 3.I did recieve the 225 weeks of permanent partial diability payments i was told that when the ppd payments end that will be it no more payment unless i cash out my medical part of the claim. 4. negotiation started 4 months after the 225 ppd payment ended i did recieve a aprovel letter for the MSA and a agreement has been reached 5. compromise and settlement. Insurance company areed to pay a lump sum in adittion to the msa and yearly installment * Lump sum $ 100,000.00 out of that includes atterney fees * Also they are asking for a credit for the 225 weeks already awarded and paid to me eaqualed to $50,000.00 * That would leave around $43,000.00 why are they going back and takeing the 225 weeks If this is how it works thats fine i realy do not uderstaned? |

the settlement was not written up as "new money"
it was written up as settlement for your whole claim less credit for amounts paid. they could have written it up for $43K new money or $100K less paid. they may have done it so your atty gets their fee on the MSA $$. why they did it one way instead of the other can best be explained by your atty --unless it's uncomfortable for them....... |
