Does an IME Notice Have to Be Filed with My Attorney

I've had a lot of ups and downs in my case in New York.

At the most recent hearing, the IME was tossed out because the IC never filed the IME-5 form with my attorney.
Today (and of course it's the weekend), I get a letter in the mail from xxx & xxx Attorneys at Law saying that the IME does NOT need to be filed with my attorney,and they are seeking a modification & reversal of the decision to toss the IME.

Does anyone know which is true ? Does the IC have to file form IME-5 with my attorney's office ?
