ssdi question
I am supposed to have a hearing this month regarding SSDI.
Iam still receiving some disability payments from the state.
and my 104 weeks of workers comp ended in july.
however the carrier resumed payments of 460.00 every 2 weeks
and the state pays me 460.00 every 2 weeks also.
my question is if I do receive ssdi will that affect my case in anyway?
carrier offer to settle my case for 60,000 back in november.
my atty stated that we are going to trial sometime in march,
I need to keep my medical open because of a potential need
for a 3 level spinal fussion down the road,I do Have a lot of restrictions by my primary doctor, and QME doctor.
Iam in CALIFORNIA Iam just concern about receiving ssdi benefits.
and state disability, I dont know if that would be a problem... thanks for your help..

I'm sorry I don't know the laws in CA but how can one get unemployment and disabilty payments? Doesn't drawing unemployment say you can work but when applying for SSDI you are saying you can't work.

Manley, he is not collecting unemployment. Cal., has a "state disability program". That is different from the Federal SSDI program.

8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins. Soilders died for our freedom.

He said his 104 weeks of unemployment ended in July so I understand he is not getting it now. But if you file for that and got it for 2 years can't you get in trouble asking for SSDI now? Or be in trouble for draw unemployment when it sounds like it should have been disabilty all along? We have to work to get enough money to live on sometimes I'm just wondering and hoping this doesn't cause him problems with one or the other.

temporary disability from workers comp insurance is not unemployment benefits.
there is no mention of unemployment in the post.
where are you seeing the words UNEMPLOYMENT?
I don't see them on my screen....

Manley2, I reread post. Slowly. I did not see the word "UNEMPLOYMENT". I was thinking (which can be scarey) That you thought his "SDI" state disability income maybe "unemplyement". At this point I am lost as to were "unemployment" came from. If you could, would you please copy if from the original post and paste it so this old "redneck" can see it???

As far as what you are saying, I agree completely. Meaning; an individual can not collect unemployment ( saying they can work), and collect WC or SSDI at the same time. I agree with you completely on that issue.

I'm thinking he edited his post because I could swear he said his 104 weeks of unemployment ended. Maybe my mind is seeing things! If he did I'm not trying to cost you any money only wanting to help you if we can. I know CA can be a funny state for anything
